Appellate Court Affirms Summary Judgment in Favor of Attorney

The Connecticut Appellate Court affirmed a decision of the Superior Court, granting a motion for summary judgment filed by RRD Associate, Peter DeMartini, on behalf of a local attorney. The vexatious litigation and abuse of process claims against the attorney and codefendants, his former clients, arose from a neighborhood dispute concerning the location and the plaintiffs’ later forcible removal of a stanchion holding the neighborhood mailboxes.

Michael Barbarula Obtain Dismissal of Fair Housing-Reasonable Accommodation Claim

RRD Associate Michael Barbarula recently obtained the dismissal of a claim brought against their client by a tenant accusing them of failing to provide a reasonable accommodation in violation of the federal Fair Housing Act and its Connecticut counterpart.

RRD Obtains Summary Judgment for Plastic Surgeon on Statute of Limitations Grounds

RRD attorneys obtained summary judgment in a medical malpractice lawsuit based only on alleged lack of informed consent. The case involves the alleged failure of a plastic surgeon to adequately inform a patient of the risks associated with “TRAM flap” (trans-rectus abdominal muscle) reconstruction of the breasts following mastectomy for breast cancer. Plaintiff underwent a two-stage reconstruction procedure by the defendant in September and October, 2010. In January, 2011, she was hospitalized for post-operative delayed wound healing and infection.

In a decision to be released on November 24, 2015 in the consolidated appeals of Lawrence v. O and G Industries, et al and Beamer v. O and G Industries, et al, the Connecticut Supreme Court re-affirmed the long settled rule that a plaintiff cannot recover purely economic damages in a tort action absent physical harm to person or property or privity of contract with the tortfeasor.
