The United States Court of Appeals for the Second Circuit affirmed a decision of the United States District Court for the District of Connecticut granting a motion for summary judgment filed by RRD Partner Michael Ryan and Associate Jonathan Zellner on behalf of several municipal officials and members of the municipality’s building board of appeals.  The plaintiff had applied for a building permit with respect to property he owned in the municipality.  His application contained a provision authorizing officials from the town’s planning and zoning and building departments to go ont

RRD Partner Rob Laney and Associate Michael Young obtained a defense verdict after a four-day jury trial on behalf of a small family-style restaurant in a premises liability case where the plaintiff’s initial pre-trial demand was $1.25 million and the plaintiff asked the jury for an award in excess of $1.5 million.  The plaintiff turned down a pre-trial offer of $350,000, opting to have the jury decide the case.

RRD Partner Rob Laney and Associate Shivani Desai won a defense verdict for the firm’s clients, a local lawyer and his law firm, after a nine-day jury trial.  The suit arose out of the client's work as the executor for the $3 million estate of a decedent who also named him as the attorney for the estate.  Despite successfully probating the estate such that it did not pay any federal or state estate taxes, the decedent’s sole beneficiary, her daughter, disputed the amount of the fees that the firm’s client charged and raised numerous claims against him, including

RRD attorneys Jim Noonan and John Kanca recently obtained summary judgment on behalf of clients in a fire loss and property damage claim.  The court ruled that in the absence of a special legal or custodial relationship, children are not liable for the negligence of their elderly parents.  This case arose from a cooking fire that caused damage to personal property owned by the plaintiffs.  The defendants’ mother, an elderly woman, owned a life estate in a multiple family dwelling that she deeded via quitclaim to her four daughters.  She was alone cooking in her unit when

A jury recently found in favor of the firm’s client, a local ophthalmologist, in a medical malpractice case defended by Ryan Ryan Deluca partner Dan Ryan.  The case involved left eye cataract surgery performed on the plaintiff in September 2009. 

RRD partner Beck Fineman successfully defended Metro-North Railroad Company ("Metro-North") in the federal district court and in the Second Circuit in a case arising out of Metro-North's decision to terminate the plaintiff's employment.  Metro-North's decision was upheld by a neutral arbitrator to whom the plaintiff appealed under his collective bargaining agreement ("CBA").  The plaintiff sued Metro-North, as well as his union and his union representative.  With respect to the claims against the railroad, the plaintiff claimed that Metro-North violated the Labor Management R
