RRD Partner John F. Costa spoke at American Conference Institute's Long Term Care Regulatory Boot Camp conference held in Chicago on July 24 - July 25, 2012. Costa, along with a panel of three other long term care attorneys, gave a two and a half hour presentation on "Developing Litigation Strategies, Substantive Arguments, and Skills to Keep Surveys out of Evidence."

 

RRD Partner Bob Hickey Wins Defense Verdict in FELA Case

RRD Partner Bob Hickey recently won a defense verdict in the United States District Court on behalf of the main commuter railroad in Connecticut.  The case was brought by a railroad employee pursuant to the Federal Employers Liability Act statute ("FELA"), 45 U.S.C. Sec. 51, that allows railroad workers to sue in negligence for on-the-job injuries caused by the negligence of the railroad.

RRD Partner Rob Laney Wins Defense Verdict for Retail Store

In a verdict returned on May 3, 2012, RRD Partner Rob Laney won a defense verdict on behalf of a large retail store in connection with a trip and fall accident that the plaintiff claimed caused her to undergo a total knee replacement.  The plaintiff fell over a hand truck that she alleged had been pushed up underneath a rack of hanging clothes, thereby preventing her from seeing it.  According to the lawsuit, the incident caused her to incur more than $100,000 in medical expenses and to require a left knee arthroplasty. 

Appellate Court Affirms Defense Verdict Won by RRD Partner Catherine S. Nietzel

In a decision released on May 1, 2012, the Connecticut Appellate Court upheld a jury verdict won in 2009 by RRD Partner Catherine S. Nietzel on behalf of two Fairfield County police officers sued for malicious prosecution by a woman who was charged with animal cruelty for her treatment of ten dogs.   The trial judge dismissed several other allegations against the officers, including those for false arrest and constitutional violations, just before the start of trial.  In her appeal, the plaintiff claimed that the court should not have allowed one of the of

Attorney Michael Young Obtains Favorable Verdict in Motor Vehicle Case

RRD Senior Associate Michael Young won a very favorable verdict in a jury trial arising out of a collision between a car and a motorcyle that caused significant injuries to the motorcyclist.  After two days of deliberation, the jury returned a verdict that was not only a fraction of what the plaintiff requested, but also significantly lower than the defendant's highest settlement offer.

Kevin Tepas Secures Another Defense Verdict in Back-To-Back Trials

On the heels of a defense verdict in a failure to diagnose case tried in early February, Partner Kevin Tepas obtained a second defense verdict on March 2 on behalf of his client, a local plastic surgeon, in a medical malpractice action in Stamford Superior Court. The plaintiff claimed that the defendant physician was negligent in performing an abdominoplasty procedure with liposuction contemporaneously with a colon resection performed by a general surgeon. The plaintiff also claimed that the physician failed to obtain the plaintiff’s informed consent in relation to these procedures.
